In view of the entry into force of Regulation 2018/848 of the Parliament and of the Council of 30 May 2018 on organic production and labelling of organic products and repealing Council Regulation No 834/2007 (hereinafter - Regulation 2018/848) in 2022, the Law on Organic Agriculture is currently being drafted, on the basis of which new Cabinet Regulations on supervision and control in the field of organic farming will be adopted.

Until the adoption of the new regulatory enactments, the Cabinet of Ministers Regulation No 485 of 10 June 2009 "Procedures for the supervision and control of organic production", the catalogue of measures to be taken in case of non-compliance and infringements set out in Annex 1.1 of which refers to Regulation No 834/2018 and Regulation No 889/2008, which have expired and been replaced by Regulation 2018/848 and Commission Implementing Regulation (EU) 2021/1165 of 15 July 2021 authorising and listing certain products and substances for organic production respectively. A number of Regulations have also entered into force to implement the provisions of Regulation 2018/848.

In the light of the above and in order to ensure the appropriate application of the norms laid down in the EU legislation, the Ministry of Agriculture has developed a new catalogue of measures for dealing with cases of non-compliance and infringements in the field of organic farming.

According to the instruction of the Ministry of Agriculture, the catalogue of measures should be used as a methodological tool for uniform application of legal norms, while any decision taken by the control body during the control should be based on a norm of the relevant normative act.
