Organic farming outside the EU - equivalence requirements

Organic farming outside the EU according to eligibility requirements Reg. 2018/848 and 2021/1698. These Regulations lay down the principles and rules on organic production, the related certification and the use of indications referring to organic production in labelling and advertising. The rules shall apply to such products originating from agriculture, including aquaculture and beekeeping, where such products are produced or intended to be produced, prepared, labelled, distributed, placed on the market, imported or exported from the European Union.

EU REGULATION 2018/848

EU Regulation 2018/848 repeal and replace the previous legislation as from 1 January 2022 (Regulation (EC) No 834/2007). Based on Regulation (EU) No 2018/848, the Commission has adopted the following secondary acts:

  • Delegated rules, which serve as general implementing acts to supplement or replace certain parts of the basic Regulation;
  • Implementing rules used to establish universal conditions for implementing certain requirements

COMMISSION DELEGATED REGULATION (EU) 2021/1698

Commission Delegated Regulation (EU) 2021/1698 (13 July 2021) Regulation (EU) 2018/848 of the European Parliament and of the Council shall be supplemented by procedural requirements for the recognition of control authorities and control bodies competent to carry out controls on operators and groups of operators that have certified organic and organic products in third countries, and by rules on their supervision and controls and other activities to be carried out by those control authorities and control bodies:

This Regulation lays down the principles and rules on organic production, the related certification and the use of indications referring to organic production in labelling and advertising. It shall apply to such products originating from agriculture, including aquaculture and beekeeping, where such products are produced or intended to be produced, prepared, labelled, distributed, placed on the market, imported or exported from the European Union.

Organic production should achieve the following general objectives:

  • contribute to environmental and climate protection
  • maintaining long-term soil fertility;
  • promote a high level of biodiversity
  • contribute significantly to a non-toxic environment;
  • promote high standards of animal welfare and, in particular, meet species-specific behavioural needs;
  • promoting short distribution channels and local production in different areas of the Union;
  • Promoting the conservation of rare and indigenous varieties threatened with extinction;
  • Promoting the development of the supply of plant genetic material adapted to the specific needs and objectives of organic farming;
  • Promote a high level of biodiversity, in particular through the use of diverse plant genetic material, such as organic heterogeneous material and organic varieties suitable for organic production;
  • Promoting the development of organic crop production activities in order to contribute to a favourable economic outlook for the organic sector.
